This bill would extend the authorities granted under Title VII of the Foreign Intelligence Surveillance Act of 1978 (FISA), which are currently set to expire, until April 20, 2029, and would also introduce new requirements and penalties related to the use of these authorities. Specifically, it mandates that the Federal Bureau of Investigation (FBI) can only ingest unminimized information acquired under Section 702 of FISA into its analytical systems if the targeted individual is part of an existing, open national security investigation, and if that individual is a U.S. person, the investigation must be supported by probable cause. Furthermore, the bill prohibits the intentional targeting of U.S. persons' communications under Section 702 unless the government obtains a warrant or court order showing probable cause that the U.S. person is a foreign agent or is committing a crime. It also establishes new criminal penalties for unauthorized disclosure or retention of classified information acquired under Title VII, unauthorized queries of U.S. person data, and falsifying compliance records, while also outlining specific defenses for certain offenses. Additionally, the bill requires the Attorney General to revoke and reissue procedures for congressional access to proceedings of the Foreign Intelligence Surveillance Court (FISC) and the Foreign Intelligence Surveillance Court of Review (FISCR), and mandates an audit by the Government Accountability Office (GAO) of the targeting procedures used under Section 702 to ensure they are appropriately limited to non-U.S. persons outside the United States.
