This bill amends Minnesota Statutes 2024, section 471.59, subdivision 8, to create an exception to the "commonality of powers" requirement for agreements between governmental units. Currently, for a county to enter into an agreement with another governmental unit to perform a service, both entities generally need to have the same powers related to that service. This bill adds a new provision that specifically allows a county sheriff to enter into an agreement with a federal agency under United States Code, title 8, section 1357(g) to perform services or functions that the federal agency is authorized to provide, without needing prior approval from the county board of commissioners and without the commonality of powers requirement. This exception is intended to facilitate cooperation between county sheriffs and federal agencies for specific law enforcement functions.
