This bill establishes new protections for consumers purchasing used motor vehicles in Pennsylvania, allowing for returns and refunds under certain conditions. It defines "dealer" as anyone in the business of selling vehicles and "purchaser" as an individual buying a used vehicle primarily for personal, family, or household use. Dealers will be required to provide purchasers with a statement from the Attorney General explaining their rights under this new law. Within 10 days of purchase, a dealer must accept the return of a vehicle and provide a full refund, minus a reasonable allowance for use (capped at 10 cents per mile or 10% of the price), unless the vehicle was damaged during the purchaser's use in a way that affects its substantial use or safety. Refunds must be issued within 30 days of the purchaser notifying the dealer, and the purchaser is generally responsible for returning the vehicle, though dealers must arrange transport at the purchaser's expense if the vehicle is too large or difficult to return. Purchasers forfeit their refund if the vehicle's condition is substantially worse and affects its use or safety, unless the dealer knew or should have known about a condition that could cause such damage. Consumers can sue dealers for failing to comply with these provisions and may recover attorney fees and court costs, with violations also considered breaches of the Unfair Trade Practices and Consumer Protection Law. Importantly, these rights cannot be waived by any party involved in the sale.
