Bill Summary

This bill grants certain emergency privileges to any vehicle owned and operated by an organ procurement organization (organization) that is transporting human organs and any associated medical personnel for time-sensitive procedures, including: (1) the use of sirens and red emergency warning lights normally reserved for certain volunteer fire company and first aid or rescue squad personnel under current law; (2) certain right-of-way privileges normally reserved for authorized emergency vehicles under current law; and (3) the use of the shoulder on roadways throughout the State. To mount and operate sirens and warning lights, an organ procurement organization is required to obtain an identification card from the New Jersey Motor Vehicle Commission (commission), through a process outlined in the bill, for any employee of the organization who is authorized to operate a vehicle on behalf of the organization for the purpose of transporting human organs and any associated medical personnel for time-sensitive procedures. The sirens and warning lights are to be mounted according to certain specifications found in current law. The bill also amends current law to clarify that a person operating a vehicle equipped with such sirens and warning lights is to obey all traffic laws of the State but that drivers of nonemergency vehicles are to yield the right-of-way to any vehicle displaying the sirens and warning lights as provided by current law. Any person operating a vehicle equipped with such sirens and warning lights in violation of the bill's provisions is to be subject to a maximum penalty of $50 and may have their ability to operate the sirens and warning lights revoked or suspended by the Chief Administrator of the commission. Finally, the bill requires the Superintendent of State Police to establish protocols for coordination between law enforcement and organ procurement organizations to facilitate the timely transportation of human organs and any associated medical personnel for time-sensitive procedures.
