This bill amends Delaware law concerning the "step therapy exception process," which is a process where insurance companies require patients to try certain medications, often less expensive generics or biosimilars, before covering a more expensive brand-name drug. The bill clarifies that insurers can still require patients to try an "AB-rated generic equivalent" (a generic drug deemed therapeutically equivalent to the brand-name drug) or an "interchangeable biological product" (a biological product that can be substituted for a reference product) before covering the equivalent brand-name drug. Additionally, it allows insurers to require patients to try a "biosimilar" (a biological product highly similar to a reference product) before covering the brand-name prescription reference product drug. These changes are made to two different sections of Title 18 of the Delaware Code, which deals with insurance.
