This bill amends Title 16 of the Delaware Code to require certain long-term care facilities, defined as nursing facilities, assisted living facilities, or group homes for persons with mental illness, to maintain specific insurance coverage. These facilities must have at least $1 million in general liability and professional liability insurance per claim, with a total of $3 million in aggregate for each type of coverage. The insurance policies must also include coverage for abuse and molestation. To operate in Delaware, these facilities must provide proof of this insurance to the Department of Health and Social Services, and this proof must be submitted with any application to renew their license, certification, or authority to provide healthcare services. Insurance companies are required to notify the Department within 14 days if a facility's coverage lapses or is canceled. Failure to maintain the required insurance will lead to the revocation of a facility's license. This Act will become effective 180 days after it is enacted.
