This bill amends Title 16 of the Delaware Code to establish new insurance requirements for long-term care facilities, which are defined to include nursing facilities, assisted living facilities, and group homes for persons with mental illness. Specifically, these "covered long-term care facilities" must maintain a minimum of $1 million in general liability and professional liability insurance per claim, with a total of $3 million in the aggregate for each type of coverage. These policies must also include coverage for abuse and molestation. Facilities will need to provide proof of this insurance to the Department of Health as a condition of obtaining and keeping their license or certification to operate in Delaware, and this proof must be submitted with any renewal application. Insurance companies are required to notify the Department within 14 days if a facility's coverage lapses or is canceled. Failure to meet these insurance requirements will lead to the revocation of a facility's license. This Act will become effective 180 days after it is enacted.
