This bill, known as the "Data Center Transparency Act," prohibits elected officials of a political subdivision (like a county, city, or township) from entering into nondisclosure agreements with data center owners who are receiving tax incentives for construction within that subdivision. A nondisclosure agreement is defined as any contract that keeps the construction of a data center confidential or prevents parties from discussing it. While this bill aims to increase transparency, it does allow for the redaction of a data center's intellectual property information from contracts, and the Attorney General, Governor's office, and Public Service Commission can still review any redacted information. This act applies to agreements made, amended, extended, or renewed after its effective date and declares any violating nondisclosure agreements void and unenforceable.
