This bill, the Frontier Risk Oversight, National Transparency, Independent Evaluation, and Reporting Act (FRONTIER Act), aims to establish federal oversight for the development and deployment of advanced artificial intelligence (AI) models, referred to as "frontier models," in commerce. It defines "catastrophic risk" as a foreseeable and material risk that a frontier model could lead to significant harm, such as the death of over 50 people or over $1 billion in property damage, through actions like assisting in the creation of weapons, engaging in cyberattacks without human oversight, or evading control. The bill mandates that "large frontier developers" (entities with substantial revenue and AI development expenditures) must create and publicly publish a "frontier AI framework" outlining their risk management strategies, undergo annual independent audits of their compliance with this framework, and publish transparency reports before deploying new or substantially modified models. Furthermore, "very large frontier developers" (those with even higher revenue and development expenditures) will be required to undergo ongoing assessments by licensed "independent verification organizations" (IVOs) to ensure their frameworks adequately mitigate catastrophic risks. The bill also grants the Secretary of Commerce the authority to issue emergency orders to suspend or restrict the development or deployment of frontier models if they pose an imminent catastrophic risk, and it preempts state laws that impose new substantive obligations on AI developers regarding risk transparency, auditing, and incident reporting, while preserving states' authority in areas like consumer protection and the protection of minors.
