This bill, by adding section 70a to existing township law, establishes new attendance requirements for township board members. Specifically, if a board member misses more than 50% of their designated "regular meetings" – which are defined as meetings scheduled in advance according to the Open Meetings Act and required by law, charter, or ordinance – within any 12-month period, they can be removed from office for willful neglect of duty. However, absences due to military service, a documented temporary medical condition, or legally permitted leave are excused, provided the member submits written documentation to the township clerk. Additionally, a township board can vote by a majority at a public meeting to excuse an absence due to extraordinary circumstances. The township clerk is responsible for notifying a board member if they miss 40% or more of regular meetings and, if the member subsequently exceeds the 50% threshold, must initiate the process for removal. The bill also clarifies that the clerk's role is to confirm receipt of documentation, not to judge its validity, and grants the clerk immunity from civil liability if they act in good faith. If a member is removed, the resulting vacancy will be filled according to established procedures in Michigan election law.
