This bill amends the Corrections Code of 1953 (specifically by adding section 67d to Michigan Public Act 232 of 1953) to regulate the use of audio, video, and photographic recording devices in private medical areas within state correctional facilities. Under the new rules, the department overseeing prisons must create and maintain policies ensuring that recording devices—which include cameras and audio recorders, but exclude telehealth equipment used to deliver remote medical care—are only used in "sensitive medical settings" (areas where prisoners have a reasonable expectation of privacy while receiving physical, mental, optical, or dental health services) when strictly necessary for safety, security, or documentation. Furthermore, the legislation requires staff to use these devices in a way that protects prisoner privacy as much as possible, formally document why a recording was made, and properly store, retain, and manage access to the resulting recordings in compliance with existing laws.
