The "Commissioner" of Health and Senior Services and the "Department" of Health and Senior Services are responsible for establishing specific measurement standards and procedures to determine what constitutes genetically modified material and how to quantify it in various food types, from raw produce to highly processed items. Foods that fail to meet these labeling requirements will be considered misbranded, subject to correction orders, and potentially liable for penalties, with the department empowered to investigate compliance. This new labeling requirement will go into effect six months after the bill is enacted.
