This bill requires the Board of Public Utilities (BPU), which is the state agency that regulates utility companies, to make a decision within 180 days after a public utility files a complete petition to sell real property it owns. If the BPU cannot decide within that timeframe due to circumstances beyond its control, it has an additional 90 days, for a total of 270 days. The BPU can also request more information from the utility within 75 days of receiving the petition to ensure it is complete. Additionally, for cases involving the sale of land used to protect public water supplies, the bill amends existing law to require the BPU to issue a decision within 180 days after receiving recommendations from the Department of Environmental Protection, with the same 270-day extension possible if necessary. The timeframes for these decisions can be extended if both the utility and the BPU agree.
