This bill allows minors who have been arrested for certain felony offenses to have their nonjudicial arrest records expunged, or cleared, by the Florida Department of Law Enforcement (FDLE) if they successfully complete a prearrest or postarrest diversion program. The bill extends the deadline for submitting an application for expunction to 12 months after completing such a program, and for those who completed a program before July 1, 2013, the application must be submitted within 12 months of that date. Importantly, the bill clarifies that expunction is available for arrests related to nonviolent misdemeanors and certain other offenses, but it specifically excludes arrests for violent misdemeanors, specific felony violations related to child abuse, sexual offenses, and other serious crimes, as well as offenses that could lead to registration as a sexual predator or offender.
