This bill amends existing Arizona law regarding marriage qualifications by removing the prohibition against marriage between persons of the same sex, which was previously stated as void and prohibited. It also modifies the conditions under which first cousins can marry, allowing them to do so if both are sixty-five years of age or older, or if one or both are younger and a superior court judge approves after proof that one cousin is unable to reproduce. Importantly, this bill will only become effective if the Arizona Constitution is amended by voters to remove its own prohibition on marriage equality.
