This bill makes it a misdemeanor in Kansas to knowingly attempt, conduct, or assist in the indefinite detention of a person apprehended within the United States without charge or trial, to prosecute such a person by a military tribunal, or to transfer such a person to a foreign jurisdiction for prosecution by the United States or any of its subdivisions. The bill clarifies that this prohibition does not apply to the court-martial of military members under the Uniform Code of Military Justice and explicitly states that acting under the authority of certain sections of the National Defense Authorization Act for fiscal year 2012, or any other federal or state law, is not a valid defense. Furthermore, individuals violating these provisions could also face charges for kidnapping or aggravated kidnapping.
