This bill makes several changes to the regulation of assisted living facilities in Florida, including clarifying that Medicaid prepaid behavioral health plans are responsible for the mental health residents enrolled in them, and that managing entities are responsible for those not enrolled in such plans. It also revises the grounds on which the Agency for Health Care Administration (AHCA) can deny, revoke, or suspend a facility's license and impose fines, increasing some of these fines and establishing new criteria for license denial. The bill mandates that AHCA regularly inspect every licensed assisted living facility, at least once every 24 months, with additional inspections required if serious violations are found. Furthermore, it requires AHCA to propose a rating system for assisted living facilities to help consumers choose a facility and to create content for its website that provides consumers with detailed information about these facilities, including their licenses, violations, and inspection reports, and allows for public comments on facilities. Other provisions include updated training requirements for staff working with residents with Alzheimer's disease or other related disorders, and enhanced resident rights information that must be posted and provided upon admission.
