This bill aims to further regulate graffiti by introducing new penalties and definitions. It makes it a misdemeanor to carry a "graffiti implement," defined as a broad-tipped indelible marker (one with non-water-soluble fluid and a writing surface of at least half an inch wide), aerosol paint container, or sticker/decal, with the intent to vandalize property in specific locations like overpasses, bridges, flood channels, public facilities, parks, or public transportation vehicles, unless authorized. The bill also classifies the act of vandalizing, placing graffiti on, or defacing property as a misdemeanor, gross misdemeanor, or felony depending on the value of the damage, with increasing penalties including fines, community service, and for those 18 and older, driver's license suspension. Furthermore, it establishes a "Graffiti Reward Fund" funded by administrative assessments on graffiti violations, which will be used to pay rewards for information leading to the identification, apprehension, and conviction of offenders, and also clarifies that parents or legal guardians of minors are liable for fines and penalties.
