This bill amends existing Massachusetts General Laws related to motor vehicle service contracts, which are agreements for a fee that cover repairs, maintenance, or replacement of parts for a vehicle, including coverage for normal wear and tear or damage from road hazards. The bill clarifies the definition of a "Motor Vehicle Manufacturer" to include various corporate structures and licensing arrangements. It also expands the definition of a "service contract" to explicitly include coverage for tire and wheel repair from road hazards, paintless dent removal, repair of minor windshield chips and cracks, and wear-and-tear damage to a vehicle's interior (excluding full component replacement). Furthermore, the bill exempts certain entities and agreements from these regulations, such as those provided by regulated public utilities, mechanical breakdown insurance policies from licensed insurers, agreements where a licensed motor vehicle dealer is obligated to perform, and warranties from builders. Importantly, motor vehicle manufacturer's service contracts on their own products are only required to comply with specific sections of the law and are exempt from certain licensure requirements.
