This bill allows municipalities that permit the creation of accessory apartments, which are defined as separate dwelling units attached to an owner-occupied single-family home and equipped with basic living facilities, to count these units towards their subsidized housing inventory. This inclusion is contingent upon the occupants meeting income eligibility standards set by the federal Department of Housing and Urban Development (HUD), with proof of income verification required by the department of housing and community development upon building permit issuance and annually thereafter. Importantly, these accessory apartments would be exempt from certain requirements of an affirmative marketing plan, including restrictions on renting to family members, and would not be subject to deed restrictions.
