This bill establishes a new chapter in the General Laws concerning public contract integrity, requiring that any "public employer" (defined as state departments, agencies, or entities providing goods or services to the commonwealth, including major authorities like the MBTA) must ensure that contractors and subcontractors register and participate in a "worker documentation certification program." This program, operated by the U.S. Department of Homeland Security or an equivalent federal agency, verifies the work authorization of new employees. The requirement to use this program will be phased in, starting with employers of 500 or more employees on September 1, 2011, then those with 100 or more employees on September 1, 2012, and finally all public employers, contractors, and subcontractors by September 1, 2013. The bill also mandates that the Inspector General develop regulations to ensure compliance with federal immigration and citizenship laws for those receiving funds through contracts, and that no public funds be spent on contracts that result in payments to individuals not in compliance with these laws. Additionally, the auditor is authorized to conduct random audits, and the attorney general will operate a confidential, toll-free hotline for reporting suspected violations related to the unlawful employment of unauthorized aliens, with all complaints being forwarded to the U.S. Attorney General and detailed in an annual report. Finally, the bill clarifies that an employer is considered in compliance if they register and participate in the program, even if an employee later provides fraudulent identification.
