This bill aims to further regulate the use of radio frequency identification (RFID) devices in the Commonwealth by amending existing consumer protection laws. RFID is a technology that uses radio waves to identify objects, animals, or people, and an RFID reader is a device that can read information from an RFID tag, which is an electronic identifier containing data about the item it's attached to. The bill introduces new definitions for these terms and establishes requirements for commercial entities using RFID systems. Specifically, stores with RFID readers in customer areas must post a conspicuous sign informing consumers that RFID technology is in use, that tags contain product information accessible before and after purchase, and the purpose of the readers. Products with RFID tags must also be clearly labeled with a logo or identifier and a conspicuous notice stating the presence of the tag and its accessibility. Furthermore, RFID tags that are not essential to a product's function must be removable by the consumer after purchase without damaging the item, and RFID readers or systems can only store, encode, or track un-purchased items, with exceptions for returns, recalls, or warranty purposes. Finally, the Attorney General is tasked with creating regulations to implement these provisions.
