Bill Summary
Relative to safe pregnancies and related health care for female inmates. The Judiciary.
AI Summary
This bill amends existing law to ensure safe pregnancies and related healthcare for female inmates in correctional facilities. Upon admission, all female inmates will be screened for pregnancy and informed about any tests. Pregnant inmates will receive counseling on their options and facility policies, and at least one medical or nursing staff member will be trained in pregnancy-related care. Pregnant and postpartum inmates will receive regular prenatal and postpartum medical care, including daily movement, proper nutrition, and postpartum depression screening. If specialized care is needed, inmates will be transferred to appropriate medical facilities. The bill also mandates that pregnant inmates have access to prenatal classes or written information, and are provided with maternity clothes and sanitary supplies. Before delivery, inmates can develop a custody plan and efforts will be made to keep infants with their mothers for up to twelve months. Post-release, inmates will receive counseling and discharge planning for continuity of care, including substance abuse treatment. The bill prohibits moving pregnant inmates to another penal institution for childbirth and allows them to remain in the hospital for at least 48 hours after delivery, with removal only upon a physician's certification of safety. During transportation for medical visits or court, pregnant inmates beyond their first trimester and postpartum inmates will generally not be subjected to restraints, except in documented extraordinary circumstances to prevent escape or harm, and leg or waist restraints are prohibited. Restraints are also forbidden during labor and childbirth, unless requested by hospital medical staff for patient safety. Finally, before release, female inmates of child-bearing age will be offered counseling and information on contraception and sexually transmitted diseases, along with a supply of contraceptives and a twelve-month prescription.
