This bill proposes to amend Chapter 112 of the General Laws by adding a new section that provides a "safe harbor" for individuals who act as "good samaritans" by offering emergency care. Specifically, it states that any person who, in good faith, attempts to provide emergency medical assistance at the scene of an emergency or while transporting someone in an ambulance or rescue vehicle, and does so without being paid for their services, will be protected from liability for their actions or omissions. This protection applies unless their conduct amounts to gross negligence or willful or wanton misconduct. However, the bill also requires that these good samaritans must ensure the injured person is placed under the care of a qualified medical professional, such as a physician or nurse, as soon as possible and must follow the instructions of that qualified person.
