This bill amends Section 70A of Chapter 111 of the General Laws, which deals with the enforcement of certain liens in personal injury cases involving hospitals. Specifically, it adds a provision that requires the expenses of attorney's fees and costs incurred in pursuing a claim against a responsible party (a "tortfeasor") and securing a judgment, settlement, or compromise to be shared proportionally between the injured person and the health maintenance organization (HMO) or hospital, medical, or dental service corporation that has a lien on the recovery. This means that if an HMO or hospital has a right to be repaid from the money an injured person receives from a lawsuit or settlement, they will now have to contribute to the attorney's fees and costs associated with obtaining that money, based on how much they receive.
