This bill clarifies that when individuals are arrested for intoxicated driving or boating, the warnings they receive about breath tests need only be provided in English, and these warnings are not considered a required part of the offense of refusing a breath test. This means that if the warnings are not given in a language other than English, it does not invalidate the refusal charge. The bill amends existing laws related to boating under the influence (C.12:7-55 and C.12:7-57), commercial motor vehicle operation (C.39:3-10.24), and general driving under the influence (C.39:4-50.2 and C.39:4-50.4a) to reflect these changes.
