This Joint Resolution proposes an amendment to the New Mexico Constitution to establish a state minimum wage that will automatically increase each year based on the rate of inflation, as measured by the Consumer Price Index for all urban consumers. Starting July 1, 2015, the minimum wage would be increased to reflect the cost of living from January 1, 2009, through the election date, and then annually adjusted. The adjusted minimum wage, rounded to the nearest five cents, would be published by the governor by May 1 each year and take effect on July 1, with no downward adjustments allowed. Employers can pay tipped employees less than the minimum wage if their tips combined with wages meet the minimum wage requirement. This resolution also clarifies that local governments can set a minimum wage higher than the state rate. The proposed amendment will be put to a vote of the people at the next general or special election.
