This bill amends New Jersey law to remove a provision that created a presumption against imprisonment for a first-time offender convicted of third-degree theft of a firearm. Previously, for certain third-degree theft offenses, including the theft of a firearm, a judge could sentence a first-time offender without imposing jail time unless specific aggravating factors warranted it. This bill eliminates that "presumption of non-imprisonment" specifically for the theft of a firearm, meaning judges will no longer be presumed to avoid jail time for this offense and will have more discretion to impose imprisonment.
