Before adopting an ordinance to allow this new use, both counties and municipalities must hold public hearings, provide extensive public notice including details about the remediation plans, estimated costs, and potential impacts, and allow for public comment. If a project exceeds $100,000, an additional public hearing and ordinance are required. The bill also specifies that the original trust funds will be dissolved and replaced with new ones that explicitly include mine remediation, and that any increase in the tax levy for these funds would require voter approval.
