This bill requires dealerships selling used motor vehicles to check for any outstanding safety recalls on those vehicles before they are sold. A "dealer" is defined as someone actively in the business of buying and selling new or used cars to the public, excluding wholesale transactions or sales to businesses that dismantle vehicles. If a recall is found, the dealer must inform potential buyers about it and whether the recall work has been completed, if they know. The bill also establishes a protection for dealers: if they check the National Highway Traffic Safety Administration's (NHTSA) website using the vehicle's identification number and the website shows no open recalls, it's presumed the dealer had no knowledge of any prior recalls, unless the recall information is added to the NHTSA website after the dealer has already printed and provided the existing information to the buyer. This new requirement will become effective seven months after the bill is signed into law.
