To be considered "eligible," an organization or individual must operate on a not-for-profit basis and possess training that meets or exceeds specific industry standards. The bill outlines procedures for approving or denying requests for these missions, requiring a decision within 48 hours and providing reasons for any denial along with guidance on how to meet the requirements. Importantly, the bill clarifies that those conducting these missions are not considered federal volunteers and are not subject to certain federal liability laws, such as the Federal Tort Claims Act or the Federal Employees Compensation Act, provided they acknowledge these provisions and sign a waiver releasing the federal government from liability. The Secretaries are also mandated to develop partnerships with search-and-recovery organizations to better coordinate and expedite these missions on federal lands.
