This bill, known as the Kansas Unborn Child Protection from Dismemberment Abortion Act, prohibits a specific type of abortion procedure where a living unborn child is dismembered piece by piece from the uterus using instruments like clamps, forceps, or scissors, with the intent to cause the child's death. This prohibition does not apply to abortions using suction to remove fetal parts or to abortions necessary to preserve the life of the pregnant woman or prevent substantial and irreversible physical impairment of a major bodily function. The bill allows for injunctive relief against those who perform or attempt such abortions and permits civil lawsuits for damages, including psychological and physical harm, triple the cost of the abortion, and attorney fees, to be brought by the woman, the father of the unborn child, or the woman's parents or guardians. Violators face misdemeanor charges for a first offense and felony charges for subsequent offenses, and the bill includes provisions to protect the anonymity of women involved in such cases and clarifies that it does not create or recognize a right to abortion or a specific abortion method.
