This bill increases the minimum wage in New Mexico and establishes a system for annual adjustments based on the cost of living. Starting January 1, 2016, the minimum wage will rise to $8.80 per hour, followed by an increase to $10.10 per hour on January 1, 2017. From January 1, 2018, and each year thereafter, the minimum wage will be increased by a percentage equal to the rise in the cost of living, measured by the consumer price index for all urban consumers as published by the U.S. Department of Labor. The workforce solutions department will announce these adjusted rates by November 1st each year, and the minimum wage will not decrease even if the cost of living falls. Additionally, for employees who customarily receive tips, their minimum hourly wage will be set at 50% of the general minimum wage, with employers needing to ensure that tips combined with the cash wage meet the full minimum wage requirement. The bill also maintains provisions for employers to deduct the reasonable value of certain items provided to agricultural workers and outlines overtime pay requirements.
