This bill allows local Conservation Commissions to enforce local wetlands ordinances or by-laws, which are local laws concerning wetlands, if these local laws are stricter than or go beyond the requirements of the state's Wetlands Protection Act (G.L. Ch. 131 § 40) and its associated regulations (310 CMR 10.00). Before a municipality can adopt such a local ordinance or by-law, the Department of Environmental Protection (DEP) must review and approve it, ensuring it has a sound scientific basis, represents a recommended best practice, is needed to protect unique local resources, and does not contradict the state law. Appeals of decisions made under these local wetlands laws will be handled by the DEP, following the procedures outlined in the state's Wetlands Protection Act.
