This bill clarifies Massachusetts franchise law, specifically concerning business practices between motor vehicle manufacturers, distributors, and dealers. It amends Chapter 93B of the General Laws by adding a provision that prohibits a manufacturer or distributor from owning or operating a dealership if, at the time that dealership was established, there was no existing franchise agreement with any independent dealer in Massachusetts for that same line make of vehicle. Additionally, the bill modifies Section 15 to allow any manufacturer, distributor, or motor vehicle dealer who suffers financial or property loss due to unfair competitive methods or deceptive practices by another entity dealing with the same line make of vehicles to sue for damages and equitable relief, provided they can prove the harm directly resulted from actions related to that specific line make.
