This bill proposes to add a new section to Chapter 85 of the General Laws, establishing a civil penalty for commercial motor vehicles or trailers that spill more than 100 gallons of gasoline, oil, or other flammable material onto public roads, which are defined as "ways" under section one of chapter 90. The penalty for such a spill would not exceed $10,000 per incident, and this would be in addition to the vehicle owner's responsibility for covering the costs of cleaning up and removing the spill incurred by the Commonwealth or any local government. The superior court department of the trial court would be responsible for enforcing this new rule, and any fines collected would be given to the city or town where the spill occurred.
