This bill modifies existing laws to better address the care and custody of individuals revived with naloxone, an opioid antagonist used to reverse drug overdoses. It allows emergency medical technicians to restrain individuals who are incapacitated due to drug use or experiencing an overdose reversal, and to request assistance from police officers, firefighters, or other first responders for restraint and transportation to a healthcare facility, with such restraints being documented. The bill also clarifies that emergency medical personnel and other authorized individuals are not personally liable for good-faith emergency aid, transportation, or admissions to hospitals, even in cases of overdose reversal. It defines "incapacitated" as a state resulting from drug use where a person is unconscious, needs medical attention, is likely to cause harm, or is disorderly. Furthermore, facilities can provide emergency treatment and observation to individuals experiencing overdose reversal, with or without consent, for a minimum of 24 hours or until the risk of overdose or incapacitation has passed, and allows police officers to use reasonable force and conduct searches for weapons or contraband in these situations, clarifying that such assistance does not constitute an arrest or criminal record. Finally, it provides liability protection for individuals who, in good faith and without compensation, attempt to render emergency care, including administering naloxone, unless their actions involve gross negligence or willful misconduct.
