This bill, concerning the siting of facilities that handle refuse, proposes that the Department of Environmental Protection (DEP), the state agency responsible for environmental regulations, cannot permit, license, site, or allow the operation of any facility that recycles, reclaims, disposes of, or transfers trash if it is located within a ten-mile radius of an already existing, licensed, sited, or operating similar facility. Furthermore, when considering whether to issue any permits or licenses for such facilities, the DEP must review the regional demand for the facility, as well as the potential negative effects on the community where the facility would be located and any communities within a ten-mile radius. This ten-mile restriction also applies to facilities that currently do not require licensing or permitting from the DEP.
