This bill establishes an independent ombudsman office, separate from the Department of Children and Families (DCF), to oversee certain DCF functions and address complaints. It also introduces a provision for the immediate suspension without pay of individuals found to have credible evidence of severe violations leading to child harm, pending a departmental investigation within 90 days, with reinstatement and no further disciplinary action if the allegations are unfounded. The new ombudsman office, located within the Supreme Judicial Court and appointed by its Chief Justice, will have the power to investigate consumer complaints, violations of DCF regulations, and potential illegal actions by DCF employees or associated agencies, with investigative tools including access to case files and the ability to issue subpoenas. This ombudsman can also enforce corrective actions and refer infractions by DCF employees, contractors, or funded non-profits to law enforcement for prosecution, particularly concerning issues like filing false reports or endangering children. Consumers will have the right to designate representatives to assist with complaints, and investigation documentation will be available to parties involved within 30 days of a written request after the investigation concludes.
