This bill proposes to amend a section of Massachusetts General Laws related to healthcare financing by changing the threshold for when a "determination of need" is required for substantial capital expenditures by healthcare facilities. Currently, such a determination is generally required for expenditures of at least $25,000,000. This bill would lower that threshold, requiring a determination of need if expenditures and acquisitions are at least $5,000,000, or if they will total $25,000,000 over a five-year period, provided these expenditures are not for the facility's own primary service area (as defined by the department) but are instead within the primary service area of another community hospital.
