This bill amends Chapter 90 of the General Laws by adding a new section that defines "buyer," "dealer" (anyone selling more than three used vehicles in a year), "private seller" (anyone not a dealer selling a used vehicle), and "purchase price." It establishes that it is an unfair and deceptive practice for a private seller to fail to use an approved bill of sale form for every used vehicle sale and to provide a copy to the buyer at the time of purchase. The Registry of Motor Vehicles will create and maintain this form, which must include specific details such as the names and addresses of the seller and buyer, vehicle information, odometer reading, known defects, the purchase price, and notarized signatures of both parties. The Secretary of Consumer Affairs and Business Regulation will create rules for the form's wording, format, and distribution. This requirement does not apply to vehicles sold for less than $700, and it does not limit existing consumer rights or warranties, although a court may consider the failure to use the approved bill of sale when awarding damages in a related legal action.
