This bill, relative to employee references, amends Chapter 149 of the General Laws by adding a new section, 52D, which provides employers with absolute immunity from civil liability when disclosing certain information about current or former employees to prospective employers. Specifically, employers are protected if they share the employee's date of employment, pay level, job description and duties, and wage history. Furthermore, if an employer responds in writing to a written request about a former employee, they are also immune from liability if they disclose written employee evaluations conducted before the employee left, and whether the employee's separation was voluntary or involuntary, along with the reasons for it. This protection applies to legal claims that arise on or after the bill becomes effective.
