This bill amends Section 12D of Chapter 112 of the General Laws concerning the substitution of generic drugs, specifically addressing prescriptions dispensed within hospitals. It clarifies that these provisions apply to prescriptions dispensed in licensed hospitals and by hospitalists or doctors. Crucially, it mandates that neither a hospital, hospitalist, nor doctor can alter a drug prescribed by a patient's primary care physician without obtaining consent from both the patient and their primary care physician. Furthermore, all outpatient prescriptions dispensed by a hospital must adhere to the required prescription form standards, and no retail pharmacy, regardless of its structure, will be exempt from these regulations.
