This bill amends Chapter 149A of the General Laws to clarify the responsibility for costs related to errors or omissions in the design of public construction projects. Specifically, it states that a "construction manager at risk," which is a contractor hired to manage a construction project from the design phase through completion, will not be held responsible for costs arising from design flaws or changes made by the public agency, unless those costs are directly caused by the construction manager's own actions or failures. This applies both to consultation services provided by the construction manager and to the indemnification, or protection against financial loss, that the construction manager might otherwise be contractually obligated to provide to the public agency or the designer.
