Bill Summary

Relative to requiring choke response training in all restaurants. Public Health.

AI Summary

This bill mandates that every restaurant, referred to as a "Food Service Establishment," must have at least one employee on duty, whenever food is being served, who has received training in approved methods for dislodging food from a person's throat, as determined by the Department of Public Health. The Department of Public Health will establish regulations outlining these approved techniques and will also inform all affected establishments of their new responsibilities, providing them with information on certified training programs. Furthermore, restaurants must arrange for adequate insurance to cover employees trained in providing this assistance. Importantly, any trained employee who acts in good faith to help someone choking will be protected from civil lawsuits for any damages resulting from their actions or inactions during the emergency, provided they were properly trained. However, this requirement does not apply to restaurants that only offer take-out orders and have no customer seating, nor to food trucks.
