Bill Summary
Under current law, public officers or other persons authorized or required by statute or court order to make a sale of real estate must advertise the time and place of the sale in the sheriffs office of the county where the real estate is located, as well as on the premises to be sold. The person also must publish notice of the sale four times, once a week for four consecutive weeks, in two newspapers as follows: (1) in two newspapers printed and published in the county where the real estate to be sold is located, one of which is published at the county seat or in the municipality with the largest population in the county; (2) if there is only one daily newspaper printed and published in the county, in one newspaper printed and published in the county and in one newspaper circulating in the county; (3) if there is no daily newspaper published in the county, then in one newspaper published at the county seat and in one newspaper circulating in the county; or (4) if no newspapers are printed and published in the county, then in two newspapers circulating in the county. To further legitimize the publishing of newsprint, this bill removes the third option of publishing the notice in a newspaper published at the county seat and in a newspaper circulating in the county if there is no daily newspaper published in the county.
AI Summary
This bill modifies the requirements for publishing notices of real estate sales conducted by sheriffs or other authorized officials. Currently, such notices must be posted at the sheriff's office and on the property, and published four times over four consecutive weeks in two newspapers. The bill specifically removes one of the existing options for newspaper publication: if there is no daily newspaper published in the county, the notice no longer needs to be published in one newspaper at the county seat and another circulating in the county; instead, it must be published in two newspapers circulating in the county if no daily newspapers are printed in the county. This change aims to streamline and potentially legitimize the process of publicizing these sales.
