This bill amends Section 9 of Chapter 70B of the General Laws, which pertains to projects funded by the school building authority, by adding a new provision requiring that any applicant seeking funding for a project must ensure that the designer hired for the project has obtained professional liability insurance. This insurance must cover negligent errors, omissions, and acts by the designer or anyone for whom the designer is legally responsible, arising from the project's design services. The minimum amount of this insurance coverage is set at fifty percent of the project's estimated construction cost, though the school building authority can mandate higher amounts. If the designer is required to pay for all or part of this insurance, they must provide proof of coverage to the applicant before the contract is awarded.
