This bill, concerning employee records, proposes to amend Chapter 149 of the General Laws by adding a new section, 52E, which grants employers absolute immunity from civil liability when disclosing certain information about current or former employees to prospective employers. Specifically, employers are protected if they share details such as the employee's date of employment, pay level, job description and duties, and wage history. Furthermore, if an employer responds in writing to a written request about a former employee, they are also immune from liability if they provide written employee evaluations conducted before the employee's departure, or information regarding whether the employee's separation was voluntary or involuntary and the reasons for it.
