This bill aims to preserve eligibility for individuals participating in the Program of All-Inclusive Care for the Elderly (PACE) and certain waivered participants, which are programs that provide comprehensive health services. Specifically, it amends existing law to address situations where an applicant or recipient's monthly income exceeds the allowed exemptions but they are otherwise eligible for Medicaid, a government health insurance program for low-income individuals. For those whose gross income is above 300% of the federal Supplemental Security Income (SSI) level (a federal program providing cash assistance to low-income individuals who are aged, blind, or disabled) but below the average cost of nursing home care, and who are enrolled in a Home and Community Based Waiver (a program allowing individuals to receive long-term care services at home or in the community instead of an institution) or a PACE Program, the bill mandates that the state division will charge a premium. This premium will be equal to the difference between their gross income and 300% of the SSI level, and the state will seek federal approval for this change.
