This bill proposes to amend Section 21 of Chapter 40B of the Massachusetts General Laws, a statute that facilitates the development of affordable housing by allowing developers to bypass local zoning regulations under certain conditions. Specifically, the bill would introduce a new paragraph that limits the density of proposed projects under Chapter 40B to no more than four times the density allowed by existing local zoning or eight units per acre, whichever is greater. However, this density limit can be waived by the local board if the developer either agrees to a 10% cap on their profits or donates an amount of money equivalent to that profit cap to the host community. This donation would then be used by the community to build more low and moderate-income housing.
